Terms and Conditions Policy

Welcome to Seedlings Retreats & Holidays. Please read these Terms and Conditions carefully before accessing or using our services.

1. Acceptance of Terms
By accessing, booking, purchasing, or using any services, accommodations, classes, memberships, products, or gift vouchers offered by Seedlings Retreats & Holidays (referred to as "Seedlings," "we," "us," or "our"), whether online or in person (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

2. Services Offered
Seedlings provides a range of wellness-focused experiences. These include, but are not limited to, holiday accommodation bookings, access to and guided sessions within our spa garden (such as private hire, contrast therapy, and ice & slice sessions), online breathwork classes and membership programmes, in-person wellness activities, classes, and therapies, UK and European wellness retreats, and the purchase and redemption of gift vouchers, alongside any other services, events, or products made available through our website or direct booking.

3. Bookings, Payments, and Cancellations
All bookings for accommodations, spa garden sessions, classes, workshops, or retreats are subject to availability and confirmation. A booking is only confirmed once full payment, or a specified deposit, has been received and acknowledged by Seedlings. All fees for Services, memberships, and products are payable in advance, unless otherwise stated. Prices are listed in GBP (£) and are inclusive of any applicable taxes unless specified. Accepted payment methods will be displayed at the point of purchase.

Gift vouchers are non-refundable and cannot be exchanged for cash. They are valid for 12 months from the date of purchase and can only be redeemed for Seedlings' Services. Lost or stolen vouchers will not be replaced.

Cancellation by Customer & Refund Policy:
The following cancellation and refund policies apply to all Services:

Holiday Accommodations:
- If you cancel your accommodation booking 60 days or more prior to your arrival date, you will receive a 100% refund excluding a £200 non-refundable deposit.
- If you cancel between 30 and 59 days prior to your arrival date, you will receive a 50% refund excluding a £200 non-refundable deposit.
- If you cancel less than 30 days prior to your arrival date, or in case of a no-show, no refund will be issued.
- Travel insurance is highly recommended for all accommodation bookings.
Wellness Retreats (UK & European):
- If you cancel your retreat booking 90 days or more prior to the retreat start date, you will receive a 100% refund of fees paid, excluding a £200 non-refundable deposit.
- If you cancel less than 10 weeks prior to the retreat start date, or in case of a no-show, no refund will be issued.
- Travel insurance is highly recommended for all retreats.
Wellness Garden Sessions (Chill and Refill 60mins, Flow and Grow 90mins and Ice and Slice) & Individual Classes/Workshops:
- If you cancel your booking 48 hours or more prior to the scheduled session/class time, you will receive a 100% refund / full credit for a future booking.
- If you cancel less than 48 hours prior to the scheduled session/class time, or in case of a no-show, no refund will be issued.
- Rescheduling is permitted with a minimum of 72 hours’ notice, subject to availability.
Memberships: Membership cancellation policies are outlined in section 4. No refunds are provided for partial use of a membership period.

Seedlings reserve the right to cancel or reschedule any service due to unforeseen circumstances, insufficient participation, safety concerns, or other reasons. In such cases, customers will be offered, at our sole discretion, an alternative date, a credit, or a full refund. We shall not be liable for any additional costs incurred by the customer, such as travel expenses. Approved refunds will be processed to the original payment method within 5-10 business days from the date of approval.

4. Membership (Online Breathwork Classes & Programmes)
Membership is subject to successful payment of applicable fees and adherence to these Terms. Membership provides access to the online content and live classes as specified in the membership description. Access may be revoked if Terms are breached.

Memberships automatically renew at the end of each billing cycle unless cancelled by the member prior to the renewal date through their account settings on our website.

Members may cancel their membership at any time through their account settings on our website. Cancellations will take effect at the end of the current billing period, and no partial refunds will be issued for unused portions of a membership term.

Seedlings Retreats & Holidays reserves the right to refuse or terminate any membership for any reason, including but not limited to breach of these Terms, inappropriate conduct, or misuse of Services. In such cases, no refund will be issued. Membership benefits, class schedules, and content may be subject to change or discontinuation at Seedlings' discretion. Members will be notified of significant changes where possible.

5. Health and Safety Disclaimer & Participation Requirements
Seedlings' services, including the spa garden, breathwork, and wellness activities, are offered for general wellbeing and recreational purposes. They are not a substitute for professional medical advice, diagnosis, or treatment. It is your responsibility to always consult with your doctor or a qualified healthcare professional before beginning any new exercise routine, wellness practice, or if you have any pre-existing health conditions or concerns, or if you are pregnant.

You acknowledge and agree that participation in our services carries inherent risks. You participate at your own risk and are responsible for assessing your own physical and mental readiness. Do not participate if you have been advised against exercise or specific therapies by a medical professional, or if you are feeling unwell or under the influence of alcohol or drugs. Leave immediately if you feel dizzy, nauseous, or unwell.

Specific Spa Garden Guidelines:

General: Surfaces may be wet; please walk slowly and carefully to avoid slips or falls. Wear appropriate footwear (flip-flops/sliders) in all hydrotherapy areas. Stay hydrated; water is available throughout the garden. No glassware, alcohol, or smoking/vaping is permitted in any spa areas. No running or rough play is allowed. Facilities are not continuously supervised, and you use them at your own risk. Respect personal space and neighbours by keeping noise quiet (below talking level). Hygiene is paramount: please shower before entering any water areas and avoid fake tan or body products in the water. Leave the spa as found and take all rubbish home. Photography is welcome in private sessions, but please be considerate of others in shared sessions. Valuables are your own responsibility; Seedlings is not responsible for lost or stolen belongings.
Age Restriction: The Spa Garden is strictly for adults 16+ only. Children under 16 are not permitted.
Chill Tank (approx. 15°C): Max capacity of 4 guests. Max time 2-3 minutes per session. This tank may be used unsupervised.
Hot Tub (approx. 37-40°C): Max capacity of 4 guests. Max time 15 minutes per session. Consult your GP before use if you have high/low blood pressure, heart or respiratory conditions, pregnancy, or serious health concerns. This hot tub is not continuously supervised.
Sauna (approx. 75-100°C): Max capacity of 4 guests. Max time 15 minutes per session. Consult your GP before use if you have high/low blood pressure, heart or respiratory conditions, pregnancy, or serious health concerns. This sauna is not continuously supervised.
Ice Bath (approx. 7-9°C): This is a structured, supervised experience. USE IS GUIDED AND SUPERVISED ONLY. Please enter only when instructed by a trained facilitator. Follow guided breathwork techniques and exit only on the facilitator's cue. Not suitable for individuals with heart conditions, respiratory issues, epilepsy, or extreme cold sensitivity. Participation in the 7°C ice bath immersion is optional and requires pre-booking, supervision, and a completed health declaration in advance. Seedlings reserve the right to deny participation if health concerns are identified.

By using our services, you knowingly and voluntarily assume all risks associated with your participation and waive any claims against Seedlings Retreats & Holidays, its instructors, employees, or owners for any injury, loss, or damages arising from your participation, except where prohibited by law.

6. User Conduct
Users are expected to behave respectfully and responsibly towards other participants, neighbours, staff, and property. Any disruptive, abusive, or unsafe conduct may result in immediate removal from the service or termination of membership without refund. Access to the harbour house changing rooms/toilets is for spa garden users.

7. Intellectual Property
All content, materials, and intellectual property included in our services (including but not limited to website content, logos, videos, recordings, class curricula, text, graphics, designs, and brand names) are the exclusive property of Seedlings Retreats & Holidays and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content obtained from our services without our express prior written permission. Recording of online classes or in-person sessions is strictly prohibited without explicit consent.

8. Disclaimer of Warranties
Our services are provided "as is" and "as available" without any warranties, express or implied. Seedlings Retreats & Holidays does not warrant that our services will be uninterrupted, error-free, secure, or meet your specific requirements. While we strive for accuracy, we do not warrant the completeness or accuracy of any information provided.

9. Limitation of Liability
To the fullest extent permitted by law, Seedlings Retreats & Holidays, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law.

10. Indemnification
You agree to defend, indemnify, and hold harmless Seedlings Retreats & Holidays and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees), resulting from or arising out of a) your use and access of the service, by you or any person using your account and password; b) a breach of these Terms; or c) any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the service using your account.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

Seedlings Retreats & Holidays reserves the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate the "Effective Date" at the top of these Terms. For material changes to existing services or ongoing agreements (such as memberships), we will endeavour to provide reasonable notice posting the updated Terms prominently on our website and notifying existing members via email prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service. Your continued use of the services after any changes signifies your acceptance of the updated Terms.
